These Terms of Service ("Terms") govern your use of ProPulse ("Service"), operated by ProPulse ("we," "us," or "our"). By creating an account or using ProPulse, you agree to these Terms.
Please read these Terms carefully. If you don't agree with them, don't use the Service.

2. What ProPulse Is
ProPulse is an AI-powered marketing platform for small and local service businesses. It provides:
- An AI-generated website for your business
- An AI concierge (chatbot) that answers customer questions
- Automated marketing — including social media ads on Meta (Facebook & Instagram) for higher tiers
- Analytics and business insights
- Customer inquiry management and SMS notifications
ProPulse is designed for legitimate business owners providing lawful services to customers.
3. Free Trial
ProPulse offers a 3-day free trial. No credit card is required to start.
- Your trial begins the moment you complete the setup wizard
- Your trial gives you access to a Tier 1 website demo only
- Facebook and Instagram ad campaigns are not available during the trial. Ads only activate when you subscribe to Tier 2, Tier 3, or Tier 4.
- No charges occur during or at the end of the trial period
- You can cancel at any time during the trial with zero charges
4. What Happens After Your Free Trial
Important — read this before signing up: After your 3-day trial ends, your site goes offline. You have 30 days to subscribe and reactivate. After 30 days with no subscription, your site is permanently closed and your data is deleted.
The 30-Day Grace Period
After your free trial expires:
- Your site goes offline (visitors see a "not available" message)
- All your data is preserved — your setup, photos, and inquiry history are safe
- You can log into your dashboard to review your account
- You have 30 calendar days to choose a subscription plan
If you subscribe during the grace period, your site reactivates instantly — no setup required.
Permanent Closure After 30 Days
If you do not subscribe within 30 days of your trial expiring:
- Your ProPulse site is permanently closed
- All associated data (business info, photos, inquiry history) is permanently deleted
- This action cannot be undone
- If you return after this point, you start fresh with a new setup
5. Subscription Plans and Billing
Tier 1 — AI Website ($49/month)
Includes:
- AI-generated website for your business
- AI concierge (chatbot) that answers customer questions
- Owner dashboard and analytics
- Instant SMS text alerts for new inquiries
- Basic SEO optimization
No ad campaigns are included in Tier 1.
Tier 2 — Marketing Boost ($149/month)
Everything in Tier 1, plus:
- AI-Powered Video Ad Campaigns on Facebook & Instagram
- Pulsed ad delivery: $10/day for 9 days per month, spread evenly throughout the month
Your $149/month is fully all-inclusive. There are no additional charges for ad spend. The $149 breaks down as follows:
- $59 — ProPulse platform fee
- $90 — Ad spend (included in your subscription price)
- $72 (80%) goes directly to Meta for ad delivery
- $18 (20%) is a ProPulse campaign management fee
Tier 3 — Marketing Pro ($349/month)
Everything in Tier 2, plus:
- 3× more ad volume — $10/day for 28 days per month (near-daily)
- Creative refresh — ad creatives updated regularly
- Weekly performance reports
- Priority campaign optimization
Your $349/month is fully all-inclusive. There are no additional charges for ad spend. The $349 breaks down as follows:
- $69 — ProPulse platform fee
- $280 — Ad spend (included in your subscription price)
- $224 (80%) goes directly to Meta for ad delivery
- $56 (20%) is a ProPulse campaign management fee
Tier 4 — Marketing Partner ($129/month + ad spend)
Everything in Tier 3, plus:
- Full campaign management & continuous optimization
- Client-controlled daily ad budget ($15–$1,000+/day)
- Continuous creative refresh
- Priority support
- Ad spend dashboard — you see exactly how your budget is allocated
Tier 4 uses a two-part billing structure:
- $129/month — ProPulse base fee (billed as a standard subscription)
- Ad spend — billed separately; you set your own daily budget (minimum $15/day)
Of your total ad spend, 20% is a ProPulse campaign management fee and 80% goes directly to Meta for ad delivery. Example at minimum spend ($15/day ≈ $450/month): total cost is approximately $579/month ($129 base + $450 ad spend), of which $360 goes to Meta and $90 is the ProPulse management fee.
Tier 4 is the only plan where ad spend is billed separately. Tiers 2 and 3 include all ad spend in the flat monthly price — you will never be charged extra for ads on those plans.
Billing Cycle
Subscriptions are billed monthly. Your subscription renews automatically each month unless you cancel. Tier 4 ad spend is charged based on actual usage each billing period.
Upgrades and Downgrades
You can upgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the start of your next billing cycle.
6. Cancellation
You can cancel your subscription at any time — no contracts, no cancellation fees.
- Cancel from your dashboard under Settings → Subscription
- You retain full access through the end of your current billing cycle
- After cancellation, your site enters the 30-day grace period described above
ProPulse does not offer prorated refunds for partial billing periods unless required by applicable law.
7. Refund Policy
If you believe a charge was made in error, contact us at support@trypropulse.com within 7 days of the charge. We review refund requests on a case-by-case basis.
We do not issue refunds for:
- Unused time on an active subscription
- Ad spend already delivered through Meta (applicable to Tier 4 ad spend billing)
- Failure to cancel before a renewal date
8. Acceptable Use
ProPulse is for legitimate local service businesses. By using the Service, you agree to:
- Provide accurate information about your business
- Only use ProPulse for lawful business activities
- Not use the Service to misrepresent your business, credentials, or services
- Not use the Service for any illegal, deceptive, or harmful purpose
- Not attempt to reverse-engineer, scrape, or abuse ProPulse's infrastructure
We reserve the right to suspend or terminate accounts that violate these rules, without refund.
9. AI-Generated Content
ProPulse uses artificial intelligence to generate your website, concierge responses, and marketing content. You acknowledge that:
- AI-generated content may not always be perfectly accurate or complete
- You are responsible for reviewing your AI-generated website and concierge content for accuracy
- ProPulse does not guarantee specific marketing results, search engine rankings, or business outcomes
- Ad performance varies based on your market, competition, budget, and other factors outside our control
10. Your Content
You own the content you provide to ProPulse (business name, photos, descriptions, etc.). By uploading content, you grant us a non-exclusive license to use, display, and process it to provide the Service.
You represent that you have the right to use any content you upload and that it doesn't infringe on anyone else's rights.
11. Limitation of Liability
To the maximum extent permitted by law:
- ProPulse is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability to you shall not exceed the amount you paid us in the 3 months prior to the claim
Nothing in these Terms limits liability that cannot be excluded under applicable law.
12. Changes to These Terms
We may update these Terms from time to time. We'll notify you of material changes by email or via your dashboard. Continued use of ProPulse after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the United States. Any disputes will be resolved through binding arbitration or in the courts of the state where we are incorporated, unless you opt out as described in any arbitration notice.
